Certificate of Authorization

Article 22 of the Loi sur la qualité de l’environnement (LQE) (Environment Quality Act) stipulates that a certificate of authorization must be obtained before the startup of certain work projects or activities.

By virtue of Articles 7 and 8 of the Regulation concerning the application of the LQE, all requests for a certificate of authorization must include the documents requested as well as the following information: identification of the party making the request, site of the project, and the nature and possible consequences of the project.

Article 7 also specifies that the Minister of the Environment may require additional information to determine the environmental consequences of the project.

Requests for a certificate of authorization must be addressed to the Direction générale de l'Environnement (Environment Branch) in the area where the project or activity will be carried out.

The time required to process a request for a certificate of authorization varies according to the complexity of the project. For regular requests, the certificate is generally delivered within three months.

For projects on the list of those subjected to southern Quebec, companies must obtain a certificate of authorization by virtue of Article 31.5 of the LQE and are then subject to the procedure for evaluating and examining environmental impacts.
